1. Acceptance of Terms

By accessing and using TapImage (“Service”), you accept and agree to be bound by the terms and conditions of this agreement. If you do not agree to these Terms of Service, please do not use our Service.

2. Description of Service

TapImage provides an AI-powered image generation service with a visual prompt builder. Users can create images by selecting prompt elements through tapping/clicking, without the need for typing complex prompts. The Service uses Z-Image technology to generate images based on user input.

3. Use License

3.1 Permitted Use

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal or commercial purposes, subject to these Terms.

3.2 Restrictions

You agree NOT to:

  • Use the Service for any illegal or unauthorized purpose
  • Generate images that violate laws, regulations, or third-party rights
  • Create content that is harmful, abusive, threatening, defamatory, or obscene
  • Attempt to reverse engineer, decompile, or hack the Service
  • Use automated systems (bots, scrapers) to access the Service excessively
  • Resell or redistribute the Service without our permission

4. Generated Content Ownership

4.1 Your Images

You retain ownership of the images you generate using our Service. We grant you full rights to use, modify, and distribute your generated images for any lawful purpose, including commercial use.

4.2 Service Rights

By using the Service, you grant us a limited license to process your prompts and generate images on your behalf. We do not claim ownership of your generated images.

5. AI-Generated Content Disclaimer

5.1 Nature of AI-Generated Content

IMPORTANT: Our Service uses AI technology to generate images. AI-generated content is inherently unpredictable and may produce unexpected, inappropriate, or offensive results even when prompted with seemingly innocent inputs. We cannot guarantee the nature, quality, or appropriateness of any generated content.

5.2 User Responsibility for Generated Content

YOU BEAR FULL RESPONSIBILITY for all images generated through your use of the Service. This includes:

  • Reviewing all generated content before saving, sharing, or distributing
  • Ensuring compliance with all applicable laws and regulations
  • Determining appropriateness of generated images for your intended use
  • Accepting all legal liability for any content you generate, save, or share
  • Not using the Service if you are under 18 years of age

5.3 No Liability for AI Output

WE ARE NOT RESPONSIBLE for any images generated by the AI, regardless of whether they are offensive, inappropriate, infringing, illegal, or harmful. The AI operates autonomously based on your prompts, and we do not pre-screen, moderate, or control the output. You use the Service entirely at your own risk.

6. Content Guidelines

You may not intentionally attempt to use the Service to generate:

  • Illegal content or content that promotes illegal activities
  • Content that infringes on intellectual property rights
  • Explicit sexual or pornographic content
  • Content depicting violence, gore, or harm to individuals
  • Content intended to harass, bully, or threaten others
  • Misleading deepfakes or impersonations without consent
  • Spam, malware, or phishing content
  • Child sexual abuse material (CSAM) or content sexualizing minors

Note: While we prohibit intentional generation of such content, the AI may occasionally produce inappropriate results. You are responsible for reviewing and discarding any inappropriate output.

7. Age Restriction

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are 18 years or older. We do not knowingly provide services to individuals under 18. If we discover that a user is under 18, we will terminate their access immediately.

8. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. The Service is provided “as is” and may be modified, suspended, or discontinued at any time without notice.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR SECURE.

WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY, APPROPRIATENESS, OR LEGALITY OF AI-GENERATED CONTENT. The AI model may produce biased, offensive, inaccurate, or inappropriate content. We do not endorse, verify, or take responsibility for any generated images.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAPIMAGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

THIS INCLUDES BUT IS NOT LIMITED TO ANY DAMAGES OR LOSSES RESULTING FROM: (a) AI-generated content that is inappropriate, offensive, infringing, or illegal; (b) your use, distribution, or reliance on generated images; (c) third-party claims related to generated content; (d) any violation of laws or regulations resulting from your use of the Service.

11. User Responsibilities and Indemnification

You acknowledge and agree that:

  • Full Responsibility: You are solely responsible for all images you generate, save, share, or distribute
  • Content Review: You must review all generated content before any use to ensure it is appropriate and legal
  • Legal Compliance: You must comply with all applicable laws, regulations, and third-party rights
  • No Harmful Use: You will not use generated images to harm, defame, or violate the rights of others
  • Age Verification: You are 18 years or older and legally able to enter into this agreement

Indemnification: You agree to indemnify, defend, and hold harmless TapImage, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your generation, distribution, or use of AI-generated content; (c) your violation of these Terms; (d) your violation of any laws or third-party rights.

12. Termination

We reserve the right to terminate or suspend access to our Service immediately, without prior notice or liability, for any reason, including breach of these Terms, generation of prohibited content, or being under 18 years of age. Upon termination, your right to use the Service will cease immediately.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the “Last Updated” date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
